These Terms & Conditions ('Terms') govern your use of the Florist Temple website and your engagement with our online flower delivery services in Temple and the surrounding areas. By placing an order with us, you agree to be bound by these Terms. Please read them carefully before making a purchase. If you do not accept these Terms, you should not use the website or place orders through it.

1. Application of Terms

These Terms apply to all orders and purchases made via the Florist Temple website, regardless of your location within Temple or the nearby areas. We reserve the right to update or change these Terms at any time, and your continued use of the website and services indicates your acceptance of any revisions.

2. Eligibility

To place an order with Florist Temple, you must be at least 18 years old and capable of entering into a binding contract under UK law. By placing an order, you confirm that you meet these criteria.

3. Order Process

Orders can be placed exclusively through the Florist Temple website. When you select your desired flowers or arrangements, add them to your shopping basket, and proceed to the checkout, you will be prompted to provide personal details including recipient information and delivery address.

After submitting your order and payment details, you will receive an order acknowledgment email confirming receipt of your order. This email does not constitute acceptance of your order. Acceptance takes place only when we send a further email confirming that your order has been dispatched. We reserve the right, at our discretion, to refuse or cancel orders for any reason, including but not limited to unavailability of products or errors in pricing or product information.

Should we be unable to accept your order, we will notify you using the details you provided and, if payment has already been made, arrange a full refund.

4. Product Availability

All products are subject to availability. In the rare event that a selected item is unavailable, we may substitute with flowers of similar style and equivalent value whilst maintaining the overall look of the arrangement. We will make every reasonable effort to contact you before making significant substitutions.

Please note that the images displayed on the website are for illustration purposes only. Due to the nature of fresh flowers, there may be minor variations in colour, stem count, and size. Seasonal availability can affect selection and design.

5. Delivery

Florist Temple provides online flower delivery within Temple and the surrounding areas only. Delivery charges and options will be displayed at checkout. We make every effort to deliver your flowers on the requested date; however, delivery dates cannot be absolutely guaranteed. We are not liable for delays due to events beyond our reasonable control (such as extreme weather, road closures, or postal delays).

It is your responsibility to provide correct and complete delivery information. If the recipient is not present at the time of delivery, we may leave the flowers in a safe location or with a neighbour, unless you have otherwise instructed us. Where neither is possible, a contact card will be left and we will attempt re-delivery where practical. Additional charges may apply for repeated delivery attempts.

6. Payments

Full payment must be made at the time of ordering. We accept major credit cards and debit cards. All prices are quoted in GBP (£) and are inclusive of VAT unless otherwise stated. Your payment will be processed securely at the time of confirming your order.

If your payment fails or is declined by your card issuer, your order will not be processed. Florist Temple takes no responsibility for any charges or additional fees imposed by your payment provider as a result of the transaction.

7. Cancellations & Amendments

You may amend or cancel your order (excluding designated Next Day or Same Day deliveries) provided we receive your request at least 24 hours before the scheduled delivery. To do so, please use the contact form on our website, quoting your order number. We cannot guarantee cancellation or amendment requests made with less than 24 hours’ notice or after dispatch has occurred. Any refunds issued will be processed to the original method of payment within 7 working days.

For orders involving bespoke customised arrangements or in busy periods (such as Valentine’s Day), cancellations may not be possible if preparation has already commenced. In such instances we will advise accordingly.

8. Quality & Returns

Florist Temple is committed to delivering fresh, high-quality flowers. If you are dissatisfied with the condition of your flowers on arrival, please notify us within 24 hours. Please retain the flowers and any packaging as they may be required for quality assessment. Where a product is deemed unsatisfactory, we will offer a suitable replacement, repair, or refund as appropriate. Our liability is limited to the cost of the product supplied and does not extend to consequential losses.

As flowers are perishable goods, statutory rights for return may not apply except where items are faulty or not as described.

9. Customer Responsibility

It is your responsibility to review your order carefully and ensure all information, including recipient details and delivery date, are correct before submission. Florist Temple cannot accept liability for failed deliveries caused by incorrect or incomplete address information provided by you.

Upon receipt of the flowers, it becomes the recipient's responsibility to care for them in accordance with any instructions provided. We cannot be held liable for deterioration resulting from improper care after delivery.

10. Liability

Our liability to you in respect of any losses arising in connection to your order or use of our services shall in no circumstances exceed the value of the order in question. We are not liable for any indirect, consequential, exemplary, incidental, or punitive damages.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any matter in respect of which it would be unlawful to limit or exclude liability.

11. General – Use of Website

Your use of our website is at your own risk. We strive to ensure our website is secure and free from viruses, however, we cannot guarantee this. We reserve the right to suspend or withdraw our site at any time for operational reasons. Any material downloaded from the website is at your own risk.

All content including images, graphics, text, and logos are the property of Florist Temple or its licensors, and may not be reproduced or used without our prior written consent.

12. Data Protection & Privacy

13. Events Beyond Our Control

Florist Temple will not be held responsible for any delay or failure to perform our obligations under these Terms if such delay or failure results from events or circumstances outside our reasonable control. This includes (but is not limited to) acts of God, adverse weather conditions, war, strikes, industrial disputes, lockdowns, riot, civil commotion, terrorist attack, fire, flood, or failure of public or private communications network.

14. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with English law. Any dispute arising out of or in connection with the use of the Florist Temple website or our flower delivery service shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision in these Terms is found to be unenforceable or invalid under any applicable law, such invalidity will not render these Terms unenforceable or invalid as a whole. Any such provision will be deleted without affecting the remaining provisions herein.

16. Entire Agreement

These Terms constitute the entire agreement between you and Florist Temple in relation to your use of our website and online flower delivery services. They supersede all prior agreements and understandings.
